A common question that every client has is how long will it take for my I-140 to be approved. My answer is always the same:

It depends on how long it takes the service center to process your case.

To keep yourself up do date with the processing times, feel free to use this handy tool from USCIS to track how long USCIS will take to process your case. Please remember that even though USCIS states that I-140s are being processed in 4 months does not mean that you will have your approval in 4 months. Factors such as requests for further evidence RFEs may slow down the processing of your case. That is why it is important to work with a qualified attorney to ensure that your case is one that will be approved within USCIS’ processing times.

We find that having a well organized I-140 petition will assist you in getting your case approved faster. If the officer reviewing your case finds that you have clearly explained that you meet all of the factors that the I-140 requires, then they will be more than happy to approve your case.  Don’t give the officer reviewing your case a reason to deny your case or issue you an RFE due to sloppy or insufficient documentation and case preparation. Casseus Law will assist you in generating a clear, concise and approvable I-140 application.
